Contractual framework

Terms of use

These terms govern the use of MonProf.ch, connections with independent tutors and the MonProf AI subscription service.

1. Scope and acceptance

By creating an account, booking a lesson, subscribing to MonProf AI or using the platform, the user accepts these terms and the privacy policy. Essential information, the price and the recurring nature of a subscription are presented before payment.

2. Tutor marketplace

For private lessons, MonProf.ch acts as an intermediary between independent tutors ("Tutors") and students or their legal representatives ("Students"). Tutors are neither employees nor representatives of MonProf.ch and remain responsible for preparing, providing the content of and delivering their lessons, as well as their tax, social security and insurance obligations.

MonProf.ch facilitates profiles, searches, bookings, communication and payments, but does not guarantee a tutor’s availability or a particular academic outcome.

3. Accounts and users who are minors

The information provided must be accurate and kept up to date. Users protect access to their account and promptly report any unauthorised use. When a student who is a minor uses the service, their legal representative is responsible for authorising use, payments and appropriate supervision.

4. MonProf AI subscription

MonProf AI is a digital service separate from lessons booked with a human tutor. After any free trial, paid access requires an explicit subscription. The price, included allowance, billing frequency and any additional packs are those displayed at the time of payment.

  • The subscription renews automatically each month until cancelled.
  • Unused monthly allowance is not carried over unless otherwise stated in the offer.
  • Additional packs are available to eligible subscribers and follow the validity period displayed at purchase.
  • Payments are processed by Stripe; MonProf.ch does not store full payment card details.

5. Cancellation, account deletion and refunds

The normal way to stop MonProf AI renewal is to use the "Cancel subscription" button in the MonProf AI area. Before deleting their account, users are asked to check their subscription status and cancel it if they wish to prevent renewal.

Account deletion and subscription cancellation involve separate processes and confirmations. Only a cancellation confirmation displayed or sent by MonProf.ch or Stripe confirms that cancellation has been processed. Without confirmation, the user must contact support.

Uninstalling the application, signing out or not using the service does not constitute confirmation of cancellation. Account deletion removes access to services and does not, by itself, entitle the user to a refund of amounts already billed, subject to applicable mandatory rights.

Fees already paid are not refunded on a pro-rata basis, except where required by law, in the event of an acknowledged billing error or by an express commercial decision of MonProf.ch. Requests may be addressed to contact@monprof.ch.

6. Limitations and responsible use of MonProf AI

MonProf AI generates explanations using artificial intelligence models. Despite the quality measures in place, its answers may be incomplete, inaccurate or incorrect. Users must exercise their judgement, verify important information and not use the service as a substitute for medical, legal, financial or other regulated professional advice.

The service is intended for learning and support. It must not be used to circumvent examination rules, commit academic fraud, produce or distribute unlawful content, harm others or attempt to compromise the platform’s security.

7. Microphone, camera and shared content

Users choose whether to enable their microphone or camera and remain responsible for what they share. They must avoid showing sensitive data, third parties without their consent, confidential documents or content for which they do not hold the necessary rights. They grant MonProf.ch and its providers permission limited to the technical processing required to provide the service.

8. Bookings, payments and disputes

The prices, commissions and conditions applicable to a lesson are displayed during booking. Payments are handled by secure providers, including Stripe Connect. Each party must respect agreed times and promptly report any cancellation, absence or dispute. MonProf.ch may help resolve a dispute in good faith, without taking the place of the parties or competent authorities.

When a payment method is saved for private lessons, the student has 48 hours after an invoice is issued to review, pay or dispute it. If no manual payment or dispute is made during this period, MonProf.ch charges the invoice amount to the saved payment method. An invoice that has already been paid is not charged again.

9. Service availability and changes

MonProf.ch takes reasonable steps to ensure the availability and security of its services. Interruptions may nevertheless result from maintenance, an incident, a third-party provider, an internet connection or an incompatible device. Features may change, in particular to improve quality or security or manage technical costs, without reducing rights already acquired for a paid period.

10. Liability

To the extent permitted by applicable law, MonProf.ch is not liable for damage resulting from inaccurate information provided by a user, the conduct of a Tutor or Student, misuse of the service, unavailability beyond its reasonable control or a decision based solely on an AI-generated answer. Nothing in these terms excludes liability that cannot be limited under mandatory law.

11. Suspension and closure

MonProf.ch may restrict or suspend an account in cases of fraud, non-payment, security breaches, harassment, unlawful content or serious breach of these terms. Where reasonably possible, the user is informed of the reason and may contact support.

12. Communications

MonProf.ch may send communications necessary for account and service operation, including sign-in confirmations, bookings, payments, security, support and important information relating to MonProf AI. These service messages are not advertising communications.

Email tips, updates and commercial offers are sent on the basis of separate consent where required. This choice is optional, is not included in acceptance of these terms and may be withdrawn at any time through the unsubscribe link or by contacting MonProf.ch.

13. Applicable law

These terms are governed by Swiss law. Mandatory consumer jurisdictions and other protections that cannot be waived remain reserved.

14. Contact

For any contractual question, payment-related request or difficulty cancelling, contact contact@monprof.ch.

MonProf.ch is an intermediary platform for private lessons and the publisher of the MonProf AI digital service. Tutors carry out their activity independently.
